By accessing or using PlankMarket, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.
You must be at least 18 years old and have the legal capacity to enter into contracts to use PlankMarket. By registering an account, you represent and warrant that you meet these eligibility requirements. You also represent that you are acting on behalf of a legitimate business entity with authority to bind that entity to these terms. Buyers may register and browse before verification, but must be approved before placing orders. Sellers may register and explore before verification, but must be approved before creating listings.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:
Sellers are responsible for the accuracy and completeness of all listing information. Sellers warrant that:
All transactions on PlankMarket are contracts between buyers and sellers. PlankMarket acts as a marketplace platform and is not a party to these transactions. Payment processing is handled through our secure third-party payment processor (Stripe). By making a purchase, you authorize us to charge the total amount including applicable fees.
PlankMarket charges the following fees:
All fees are subject to change with 30 days notice. Fees are non-refundable except as required by law or as explicitly stated in our refund policy.
When a buyer completes a purchase, funds are held securely by our payment processor (Stripe). Funds are automatically released to the seller's connected Stripe account once the shipment is confirmed picked up by the carrier. Sellers typically receive funds in their bank account within 3-5 business days after release.
PlankMarket uses a secure hold-and-release payment model. This is not a regulated escrow service. By using the platform, you acknowledge that PlankMarket is not acting as an escrow agent, trustee, or fiduciary.
Surplus flooring materials are sold in the condition described in the listing. Common condition grades include:
Sellers must accurately describe the condition of materials. Buyers acknowledge that surplus materials may have minor variations and should review all listing photos and descriptions carefully before purchase.
Shipping Responsibility: Unless otherwise agreed between buyer and seller, the buyer is responsible for carrier shipping charges. PlankMarket may facilitate shipping quotes and booking through integrated freight carriers. PlankMarket may absorb payment processor costs related to the shipping portion of the order.
Packaging Requirements:Sellers must ensure all materials are properly palletized, banded, and stretch-wrapped for LTL freight shipment. Inadequate packaging that results in damage during transit is the seller's responsibility.
Required Shipment Information: Sellers must provide accurate weight, dimensions, pallet count, and material classification for freight quotes.
Risk of Loss: Title and risk of loss transfer from seller to buyer upon carrier pickup. Freight damage claims should be filed with the carrier, with PlankMarket assisting in documentation.
Delivery Receipt: Both parties acknowledge that the signed delivery receipt (Bill of Lading) serves as the primary evidence of shipment condition at delivery.
Buyers must inspect all shipments upon delivery and note any visible damage, shortage, or discrepancy on the delivery receipt (Bill of Lading) at the time of delivery.
Buyers have 48 hours after delivery to report damage, shortage, or material discrepancy to PlankMarket with supporting evidence including:
If no dispute is reported within 5 business days of confirmed delivery, the transaction is considered complete and final.
In the event of a dispute between buyer and seller, PlankMarket will mediate in good faith. Both parties agree to:
For disputes exceeding $5,000, either party may pursue resolution through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted in the State of Wyoming.
CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
If a buyer initiates a chargeback or payment reversal through their payment provider, PlankMarket reserves the right to:
Sellers are protected from chargebacks on transactions where delivery is confirmed and no valid dispute was raised within the inspection period.
By listing materials on PlankMarket, sellers represent and warrant that:
Sellers agree to indemnify and hold harmless PlankMarket from any claims arising from misrepresentation, intellectual property infringement, product defects, or regulatory non-compliance related to their listings.
The following items and activities are strictly prohibited:
PlankMarket provides the platform on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the quality, accuracy, or availability of products listed. To the fullest extent permitted by law, PlankMarket shall not be liable for:
Our total liability shall not exceed the fees paid by you to PlankMarket in the 12 months preceding the claim.
All content on PlankMarket, including logos, trademarks, text, graphics, and software, is the property of PlankMarket or its licensors and is protected by copyright and intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
We reserve the right to suspend or terminate your account at any time for violations of these Terms of Service or for any other reason at our sole discretion. Upon termination, your right to use the platform will immediately cease, and we may delete your account and associated data.
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of PlankMarket after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Wyoming.
PlankMarket is operated by ABM Studios LLC, a Wyoming limited liability company.
